These Terms of Use (these "Terms") represent an agreement between you and Design with Frank and govern your use of this website and any products or services, including FRANK sets (“Plans”) made available via this website from time to time.

This website, together with such products or services, is referred to collectively as the “Site” in these Terms.

By using the Site, whether for purposes of viewing or ordering Plans or otherwise, you acknowledge that you have read and understood, and agree to be bound by and comply with, these Terms.

Terms of Service

As all sales are final, please ensure that the plan you have chosen meets your needs. There are no returns or exchanges.

Design with Frank, Inc. provides residential design consulting and pre-designed floor plans only. Design with Frank, Inc. does not provide architectural services, engineering services, or construction administration. Design with Frank, Inc. is not acting as the Architect of Record for any project.

All plans sold by Design with Frank, Inc. are conceptual and illustrative in nature. A locally licensed architect and/or engineer must review, modify, and stamp the drawings as required by the Authority Having Jurisdiction prior to construction.

Design with Frank, Inc. expressly disclaims any responsibility as Architect of Record, Engineer of Record, or Construction Administrator for any project using its plans.

Building codes, zoning ordinances, energy codes, and permitting requirements vary by jurisdiction and may change over time. Design with Frank, Inc. makes no representation or warranty that any plan complies with local codes, zoning regulations, or permitting requirements.

It is the responsibility of the Owner and their licensed design professionals to verify all code, zoning, and regulatory compliance.

Plans provided by Design with Frank, Inc. are not site-specific and do not account for site conditions including, but not limited to, soil bearing capacity, topography, drainage, flood zones, seismic conditions, wind exposure, or utility locations.A site-specific evaluation by licensed professionals is required prior to construction.

Building and code standards will vary by state, county, and municipality. Your plan may need to be adjusted to meet certain regional criteria. This is especially true in coastal regions and places that frequently experience earthquakes, strong winds, and a lot of snow. A qualified structural engineer will probably be required to give the relevant calculations and extra drawings if you are building in any of these locations. We grant you a permit on our plans under the condition that you undertake to rigorously abide by all applicable local building laws, ordinances, regulations, and requirements, including those about permits and inspections at the start of and throughout construction. For the most recent requirements, we advise contacting your local building department.

There is no licensed architect's signature on any of the Design with Frank pre-drawn drawings. If your local building department demands it, you must hire an architect or engineer to examine and approve stamp drawings.

Engineering Disclaimer (Structural / MEP)

Structural, mechanical, electrical, plumbing, and energy calculations are not included unless explicitly stated. All structural and MEP systems must be designed, reviewed, and approved by licensed engineers retained by the Owner or Contractor.

Construction Means & Methods Disclaimer

Design with Frank, Inc. has no control over construction means, methods, techniques, sequencing, or safety procedures, and shall not be responsible for the acts or omissions of contractors, subcontractors, or suppliers.

No Construction Administration Disclaimer

Design with Frank, Inc. does not provide construction observation, site visits, shop drawing review, RFIs, or field directives unless separately contracted in writing under a licensed architectural entity.

Plan Use & Modification Disclaimer

Plans may not be modified, reused, or adapted without review by a licensed design professional. Design with Frank, Inc. is not responsible for errors or omissions resulting from modifications made by others.

Performance & Cost Disclaimer

Design with Frank, Inc. does not guarantee construction cost, energy performance, material availability, or schedule. Any cost estimates or performance references are conceptual only.

Limitation of Liability

To the fullest extent permitted by law, Design with Frank, Inc.’s total liability for any claim arising from the use of its plans shall be limited to the amount paid for the plan.

Reliance Disclaimer

The Owner assumes all responsibility for determining the suitability of the plans for their intended use. Use of the plans constitutes acceptance of this responsibility.

No Warranty Disclaimer

All plans are provided “as-is” without warranties of any kind, express or implied.

All plans remain the sole property of our designer. The right to use these plans to build a single structure is granted to you, the licensee, by our designer, who is the licensor.

All our plans are protected under the Federal Copyright Act, Title XVII of the U.S. code, and Chapter 37 of the Code of Federal Regulations. The plans licensed to you cannot be used or resold to another individual. These plans cannot be copied or reproduced by any means unless specifically authorized.

You might be communicating with us electronically when you use our website, send us emails, or text messages, or send other communications from your desktop or mobile device. With this, you agree to receive communications from us electronically, such as emails, texts, mobile push notifications, notices, and messages on this site or through other AD services (including marketing communications, unless you have opted out where applicable). You acknowledge that all agreements, notices, disclosures, and other communications that we send to you electronically satisfy any legal requirements for a written form of communication.
